Terms of Service: Monkeys in Space

These Terms govern your use of Monkeys in Space, including the website and web app at monkeysinspace.app, bio pages, smart links and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Who can use Monkeys in Space

• You must be at least 18 years old to create an account or use the Service.
• By signing up, you confirm that you're 18 or older and legally able to agree to these Terms.
• If we learn that a user is under 18, we'll close the account and delete its data.
• If you use the Service for a business, you confirm you're authorized to act for that business. "You" then includes the business.

2. Your account

• Keep your login details secure. You're responsible for activity on your account.
• Give us accurate information and keep it up to date.
• Tell us right away at support@verlolabs.com if you think someone else has accessed your account.

3. Connecting TikTok, YouTube and other platforms

• You can connect accounts you own or are authorized to manage on third-party platforms such as TikTok and YouTube ("Connected Platforms").
• YouTube: By connecting a YouTube account, you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms (opens in a new tab). Our use of YouTube data is described in our Privacy Policy, which also explains how to revoke access through your Google security settings: https://security.google.com/settings/security/permissions (opens in a new tab).
• TikTok: By connecting a TikTok account, you also agree to follow TikTok's terms that apply to you.
• You can disconnect a Connected Platform at any time in Settings. When you do, we delete that platform's data as described in our Privacy Policy.
• Monkeys in Space is not affiliated with, endorsed by or sponsored by TikTok, YouTube, Google or Meta. Their names are used only to identify the platforms you connect.
• Connected Platforms can change or limit their data and features at any time. That can affect what the Service can show you, and we're not responsible for those changes.

4. Smart links and bio pages

• You can create a public bio page (for example monkeysinspace.app/yourname) and short links that redirect to destinations you choose ("Smart Links").
• Bio pages and Smart Links are public. Anyone with the link can see them.
• You're responsible for the destinations and any content on your bio page. Don't link to or post anything that:
  • is illegal, fraudulent, deceptive, or phishing or malware
  • infringes anyone's intellectual property or privacy
  • is sexually explicit or involves minors in any sexual context
  • harasses, threatens or promotes violence or hate
  • is spam or impersonates someone else
• We may disable a link or bio page that breaks these Terms, with or without notice.
• We count clicks on Smart Links to give you analytics. See the Privacy Policy for what we collect.
• We may reserve or reclaim a handle or link name, for example if it's inactive, misleading or infringes a trademark.
• To report a link or bio page that breaks these rules, email privacy@verlolabs.com.

5. Free during launch, plans, billing and cancellation

Free during launch:

• The Service is free during launch. Features may change, break or be removed, and there's no guarantee of uptime or data completeness while we're launching.
• There's no charge during launch. We'll give you clear notice and ask for your agreement before any paid plan, and we'll never charge you without your explicit agreement.
• During launch, you get features we may later include only in paid plans, at no charge. That's temporary: if we introduce paid plans, some of those features may need a paid plan, and we'll tell you before that changes.

If we introduce paid plans (there are none yet), the following will apply:

• Some features will be free. Others will require a paid plan (for example Creator Pro or Business). Plan features and prices will be shown on our pricing page and can change. We'll give you notice before a price change affects your plan.
• Paid plans will be billed in advance through our payment processor (Stripe) and will renew automatically each billing period until you cancel.
• You'll be able to cancel anytime in Settings. Cancellation will take effect at the end of the current billing period, and you'll keep paid features until then.

• You'll be responsible for any taxes that apply, other than taxes on our income.

6. AI-generated insights

• AI features are switched off for now. When they're on, some features use AI to write summaries, explanations and suggestions based on your data. AI-generated text is labeled.
• AI output can be incomplete or wrong. Treat it as general guidance, not professional, financial or legal advice. Decisions about your content and business are yours.
• We don't guarantee any growth, views, followers, clicks, income or other results.

7. What you can't do

Don't:

• break any law, or these Terms
• scrape, crawl or copy the Service or its data, or use bots to access it, except through features we provide
• reverse engineer, decompile, or try to get the Service's source code, except where the law allows it
• interfere with or disrupt the Service, get around its security or usage limits, or access other users' data
• resell, sublicense or rent access to the Service without our written permission
• use the Service to send spam or unsolicited advertising
• misrepresent your identity, or connect accounts you're not authorized to use

8. Your content and data

• You keep ownership of your content: bio page text, links, tags and other material you add ("Your Content").
• You give Verlo Labs a limited license to host, store, display and process Your Content only to run and improve the Service for you, and to show your public bio page and links.
• Data from Connected Platforms is handled as described in our Privacy Policy. We don't sell it.

9. Our intellectual property

• The Service, including its software, design, logos and the name "Monkeys in Space", belongs to Verlo Labs.
• These Terms don't give you any rights to our intellectual property, except to use the Service as allowed.
• If you send us feedback, we can use it without owing you anything.

10. Suspension and termination

• You can stop using the Service and delete your account anytime in Settings.
• We may suspend or close your account if you break these Terms, create risk or legal exposure for us or others, or if a Connected Platform requires it.
• We also close accounts that go 12 months without being used, unless they're on a paid plan, as our Privacy Policy explains.
• When an account closes, we delete its data as described in our Privacy Policy. Sections 6, 8 (last point), 9, 11, 12 and 13 continue to apply after the account closes.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We don't warrant that:

• the Service will be uninterrupted or error-free
• data from Connected Platforms will be complete, accurate or timely
• any alert, insight or analytic will be correct

12. Limitation of liability

To the fullest extent the law allows:

• Verlo Labs won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
• Our total liability for any claim about the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) $100.

13. Indemnity

You agree to defend and indemnify Verlo Labs against claims, losses and expenses (including reasonable legal fees) that come from:

• Your Content or your Smart Link destinations
• your breaking these Terms or the law
• your use of Connected Platforms

14. Governing law and disputes

• These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
• Disputes will be resolved in the state or federal courts located in [PLACEHOLDER: e.g. New York County or Kings County], New York, and you and we consent to their jurisdiction.

15. Changes to these Terms

• If you keep using the Service after changes take effect, you accept the updated Terms.
